2.4. Our company provides a platform to connect customers with delivery partners as such our service is limited to connecting customers with delivery partners.
2.5. "Writing" includes emails. When we use the words "writing" or "written" in these terms, this includes emails.
3. OUR CONTRACT WITH YOU
3.1. Our acceptance of your order will take place when you accept our terms and condition on being prompted or by paying for a service via our telephone service, at which point a contract will come into existence between you and us. We act as agent on your behalf in relation to the services of our delivery partners which shall be provided by our delivery partner to you directly and in relation to the payment you make to pay for our services and the services of our delivery partner which will be processed via our service.
4. YOUR RIGHTS TO MAKE CHANGES
4.1. If you wish to make a change to the product you have ordered please contact us or your delivery partner. You will then be notified if the change is possible. If it is possible we will let you know about any changes to the price of the revised services, the timing of supply or anything else which would be necessary as a result of your requested change and ask you to confirm whether you wish to go ahead with the change.
5. PRICE AND PAYMENT
5.1. The cost to you of our services to act as your agent and the cost to you for the services of our delivery partner will be the price indicated on the order pages when you placed your order. We take all reasonable care to ensure that the price of our services is correct.
5.2. We will state the amount of VAT that relates to our service acting as your agent and the amount of VAT relating to the services of our delivery partner delivering the actual service to you directly. Our Delivery partner will invoice you and send to us their invoice and these details will be included in our invoice to you as a disbursement. If the rate of VAT changes between your order date and the date we supply the service, we will adjust the rate of VAT that you pay, unless you have already paid for the product in full before the change in the rate of VAT takes effect.
5.3. We accept payment with Visa, Mastercard & American Express, you must make an advance payment of 100% of the price of the services inclusive of all VAT payable for these services, before our delivery partner start providing them.
5.4. If you are a business customer you must pay all amounts due to us under these terms in full without any set-off, counterclaim, deduction or withholding (other than any deduction or withholding of tax as required by law).
7.1. You are required to use our website lawfully and not transmit any virus or otherwise use our website in any manner which would be harmful to our website or our business.
7.2. If you have any experience on our website that is negative, interrupted or erroneous, please get in touch with us and we will work to improve our website.
8. APPLICABLE LAW
8.1. These terms are governed by English law and you can bring legal proceedings in respect of the products in the English courts. If you live in Scotland you can bring legal proceedings in respect of the products in either the Scottish or the English courts. If you live in Northern Ireland you can bring legal proceedings in respect of the products in either the Northern Irish or the English courts.
8.2. If you are a business, any dispute or claim arising out of or in connection with a contract between us or its subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the law of England and Wales and the courts of England and Wales shall have exclusive jurisdiction to settle any such dispute or claim.
